How do I know if I must file a Police Report?

  • Rape
  • Forcible Sodomy
  • Sex Offense
  • Kidnapping
  • Assault and Battery with a Deadly Weapon
  • Child Abuse
  • First Degree Murder (Petitioner is an Immediate Family Member of the Victim)

Police Report is REQUIRED for Final Order of Protection


Police Report IS NOT required for

  • Emergency Temporary (weekend) Order
  • Emergency Ex Parte Order
  • Stalking
  • Other Crime Not Listed Above

After you file a police report

To get a protective order based on stalking or harassment, you must file a police report before filing the petition for protective order with the court. You must include the police report date and report number when you file the petition for protective order.

At the time you make the report, you will not be able to get a copy. The Officer will usually give you a paper that shows you the date, time, and police report number so that you can request a copy.
